KK Pathak, Additional Chief Secretary of the Education Department, has come on the back foot in his attempt to encroach on the authority of the District Magistrates to implement Section 144. Patna DM Dr. Chandrashekhar Singh had appealed to the Chief Secretary to find a solution, protesting against the repeated interference of the Education Department against his order to close schools due to cold. Now KK Pathak himself has told all the District Magistrates not to interfere in the closure of schools under Section 144, but at the same time, while sarcastically, he has also put an interesting condition. Due to cold, all the DMs used to issue orders for their districts on their own behalf after the orders of the District Magistrate of Patna. When Pathak objected to this right, most of them laid down their arms out of fear. Pathak is now on the back foot after the Patna DM’s retaliation with the continuous reports of children dying and falling ill due to keeping schools open.

Know what was written in the letter

KK In the letter issued by Pathak, it is written that according to India Meteorology, there is a possibility of cold wave till January 29. In the light of this, DMs of all the districts are instructed to amend the visiting time of students from class 1 to 8 in the school till January 29, but the study time of class 9 to 12 and board preparation will not be disrupted. Will happen. Also, as before, all the teachers will remain present in the school for their fixed period and will perform administrative work like DBT, renovation, furniture purchase etc. and will remain in the school for the period fixed by the department.

Know what was said regarding Section 144 CrPC

It was further written in the letter that for the last several years, the District Magistrate has been closing schools under Section 144 CrPC due to cold wave or other reasons. This practice has been opposed by the department in the past years also. In the same sequence, in the letter issued on January 20, it was made clear that the department does not support the trend of closing schools by imposing 144 CrPC. Therefore, it is requested that the functioning of schools cannot be controlled through Section 144 CrPC. However, if you consider that you may interfere with the functioning of the school under Section 144 CrPC, the Department also expects you to comply with this section in the coming months when the weather becomes normal.
